TourNinjaPhuket Terms & Conditions

TourNinjaPhuket is a fully registered Thai limited company, licensed by the Tourism Authority of Thailand. We focus on using our local knowledge and expertise to connect customers with specially selected quality operators of tours and excursions in and around Phuket Thailand, so that customers may have the most memorable and unique experiences during their holiday.

Definitions.
The terms Customer, Traveler, Guest or “you” refer to the traveler booking a Product or Tour with us and all members of their group.

The terms TourNinjaPhuket, tour agent, ”we” or “us”  refer to Tour Ninja Phuket Co.Ltd., a Thai Limited Liability Company and/or our affiliates, and subsidiaries. The tour agent is the link between the customer and the tour operator. The tour agent has a moral responsibility towards the customer.

The terms Tour operator, supplier or service provider refer to the organization who is responsible for the tour and who is organizing and operating the tour and/or hotel transfer. The tour operator has a legal responsibility towards the customer.

The Products are the variety of tours and services made available by TourNinjaPhuket staff and our partners and related applications via our website located at www.TourNinjaPhuket.com (collectively, “Website”).

Agreement.
These Terms and Conditions including all brochures, documents, correspondence and the terms and conditions of our Suppliers form the basis of the Agreement with you. Before making a booking with us you must ensure that you have read and understood these Terms and Conditions (raising any questions you may have with us). Please be aware that these terms and conditions contain waivers of liability as well as waiver of class action and venue selection and notice clauses. By asking us to confirm your booking you are accepting all of the Terms and Conditions laid out below and you acknowledge that you have read the Terms of this agreement and agree with them. 

If you are making a booking as a group, the leader of the group is responsible for sharing these Terms and Conditions with all members of the group and is financially responsible for the booking. We will not be liable for a group leader’s failure to share these Terms with all travelers in their group.

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these Terms and Conditions on their behalf, and (c) the information supplied by you, or members of your group is true and correct.

Changes to these Terms and Conditions.
We may change or otherwise modify this Agreement from time to time, and you understand and agree that your continued access or use of this Website after such change signifies your acceptance of the updated or modified Agreement. We will note the date that revisions were last made to the Agreement at the top of this page, and any revisions will take effect upon posting. You are advised to return to this page periodically to review the most current version of the Agreement. 

Violations by You.
You agree that any violation of any of these Terms and Conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) your being denied access to the applicable travel related product or service.

COVID 19 Release of Liability.
By booking a tour at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time you book your tour. You acknowledge that exposure to such viruses or disease is an inherent risk of traveling, which cannot be controlled or eliminated by TourNinjaPhuket.

You acknowledge that due to the uncertainty of travel at this time, your tour may be postponed or canceled, or changes may be made to itineraries due to closures of certain sites or activities, for which there may be no refund. You may also be required to quarantine if you test positive at any point on a tour. Some locations may require you to have a vaccination. You are responsible for understanding these requirements and must not rely on TourNinjaPhuket to provide these details. You understand that you may become sick before, during, or after the tour and may not be able to travel and such cancellation or interruption will be subject to our cancellation terms below, for which we will not be liable.

You agree that due to uncertainty caused by COVID 19, TourNinjaPhuket has strongly encouraged the purchase of travel protection coverage including “cancel for any reason” coverage if and when available, and that should you fail to purchase travel protection coverage, TourNinjaPhuket shall not be liable to any losses howsoever arising. TourNinjaPhuket shall not be liable for any COVID losses not covered by your selected travel protection coverage. 

You, for yourself, and for any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives and next of kin (The Releasors), HEREBY RELEASE, AND HOLD HARMLESS Tour Ninja Phuket Co.Ltd., its officers, agents, and/or employees, Suppliers, and other tour members (RELEASEES), of from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

Products, Services, and Booking Reservations.
When you are ready to start your next travel adventure with us simply search for the tour you are looking to experience, read through the description detail in full, input your information into the participant information box, and select “CHECK AVAILABILITY.” You will be asked to submit your email address for communication regarding availability and further processing of your reservation. Should you have any questions about a tour, please be sure to contact us via WhatsApp or email, as listed on our website, or call us at any of the mobile numbers listed on our website prior to booking any tour. You will receive an email to advise you that we are checking availability. Once we have confirmed availability with the tour operator, we will send you a second email, to advise you that the tour spaces are available as requested. At this time, you are expected to make payment in full, for the reservation to proceed. Payment is always due in full at the time of booking. Failure to make a payment may result in the cancellation of your participation on the tour. Payment instructions will be provided when you click on the relevant link in the email. Upon completion of payment, the PayPal system will send you a conformation of payment. We also receive confirmation of your payment, and at that time we will confirm your reservation and we will attach your TourNinjaPhuket Tour Voucher. The Tour Voucher is your proof of payment and you need to provide it to the Tour Operator on the day of your tour. You may do so by either showing an electronic copy of the Tour Voucher on your phone or tablet, or in printed paper form. By booking a tour with us, you acknowledge that you accept the practices described in this Agreement. Any false or fraudulent reservation is prohibited.

Our tours or bookings do not include airfare. Your contract for airfare is with the air carrier and subject to its terms. We shall not be liable for any change fees or cancellation fees or other additional costs/s you incur with the air carrier.

TourNinjaPhuket Promotional Deals or Discounts.
From time to time TourNinjaPhuket offers discounts and time-limited promotions. Promotional Deals or Discounts are confirmed instantly upon booking and all sales are final. If you cancel or amend a Promotional Deal or Discount, you will be charged a 100% cancellation fee.

Credit Card Bookings.
When you book a reservation for a service or product through the Website, you must make payment via the PayPal portal, paying with your credit card or your PayPal account. This means that TourNinjaPhuket does not collect your credit card information to processes your payment. You agree that under this agreement, the payment processing services for services purchased on this website are provided by PayPal or by Tour Ninja Phuket Co.Ltd., depending on the type of payment method used for the purchase of services.

All prices on our website are listed in Thai Baht. The value of the transaction may be subject to taxes, duties, foreign transaction, currency exchange or other fees. Your bank or credit or debit card company may convert the payment into your local currency and charge fees, resulting in differences between the amount displayed on TourNinjaPhuket.com and TourNinjaPhuket-affiliated websites, and the final amount charged to your bank account or credit or debit card statement. Please contact your bank or card company if you have any questions concerning any applicable conversion or fees.

You agree and acknowledge that by entering your credit card information your card will be charged in full for any and all tours in your “cart” on the Website, and as such agree not to dispute any charge or make any improper chargebacks.

In certain cases, you have the ability to dispute charges with credit card companies (“chargebacks”). Before initiating a dispute, we ask you to contact us first, to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. TourNinjaPhuket retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. 

Currency Converter.
Where a currency converter is provided on the Website and other applications, currency rates are based on various publicly available sources and should be used as guidelines only. Rates are not verified as accurate, and actual rates may vary. Currency quotes may not be updated on a daily basis. The information supplied by this application is believed to be accurate, but TourNinjaPhuket, and/or its affiliates do not warrant or guarantee such accuracy. When using this information for any financial purpose, we advise you to consult a qualified professional to verify the accuracy of the currency rates. We do not authorize the use of this information for any purpose other than your personal use and you are expressly prohibited from the resale, redistribution, and use of this information for commercial purposes.

Modifications & Amendments.
All requests for modifications and amendments to your booking must be directed to the TourNinjaPhuket Customer Care Team who will process the request. See the section “Payment & Cancellations” below for additional information with respect to canceling a booking.

• TourNinjaPhuket does not charge a fee to amend or change the dates of an existing booking if the request is received by our Customer Care team more than two (2) days ahead of your confirmed travel date.
• All date-change requests and amendments are subject to availability and approval by our service provider/s; TourNinjaPhuket cannot guarantee the success of any date-change request.
• If you request a date change within two (2) days or less of your confirmed travel date, TourNinjaPhuket will attempt to honor your request; however, changes made two days or less from your original travel date may be subject to an additional fee. For multi-day and overnight tours, date changes made within seven (7) days of your confirmed travel date may also be subject to additional fees.
• If you make a purchase using a TourNinjaPhuket promotion code, or if you accept a discount or special-offer price during the TourNinjaPhuket checkout process, you may invalidate your discount or special-offer price by making any changes or amendments to your itinerary once your purchase is complete. TourNinjaPhuket may decide, at its sole discretion, to honor your discount or special-offer pricing if you make a post-purchase change or amendment to your itinerary. However, TourNinjaPhuket reserves the right to invalidate your discount or special-offer pricing if you make any changes to your confirmed itinerary.

Occasionally our team and/or service providers make changes to tour dates, prices, inclusions, coverage, age requirements, and other Product features and/or requirements. As a result, TourNinjaPhuket reserves the right to cancel, change or substitute any service, tour, ticket or product that you have booked at this Website, at any time, for any reason. In such cases, if you are dissatisfied with the alternatives offered, you are entitled to a full refund of the original purchase price. Notwithstanding the above, when we are informed in advance by our service providers of a significant change to a booking and/or to a tour, product or event, we make every reasonable effort to notify the customer, travel agent and/or distributor as appropriate, in order to amend or re-issue the booking where feasible. The customer is responsible for any additional costs for air tickets or other travel arrangements not made by us.

Pricing & Inclusions/Exclusions.
Prices listed on the Website are in Thai Baht and are per person, unless otherwise specified. Price quotations are subject to change without notice, until a booking has been confirmed.

Transfers.
Certain tours include transfers by car, truck-taxi, van or bus. You must be on time for all transfers. There will be no refund for missed or unused transfers. For transfers where we pick you up to commence the tour, please be sure to provide us with the correct pick-up location and arrive there 15 minutes prior to the pickup time.

Meals.
Meals and/or snacks are not included on all tours, please refer to the inclusions listed on your itinerary to confirm the included meals and snacks on your tour. Travelers with special diets should make such a request at the time of booking; however, it may not be possible for special diets to be catered to on some of the tours we feature. For safety and liability reasons, TourNinjaPhuket and its representatives cannot be responsible for directly accommodating any food allergies, or dietary requirements and restrictions, and is not responsible for any issues or problems associated with the same. We will advise Suppliers of your request, but we cannot guarantee their availability.

Sightseeing/Activities.
Sightseeing tours and activities are included as provided in the individual itineraries. These tours and activities are designed to accommodate individuals as well as groups. As a courtesy to others in the tour and/or activity, it is mandatory that you be on time for all scheduled experiences. Tours and activities will begin on time and failure to arrive will be considered a no-show for which no refunds will be available. It is essential that you keep in mind that tour and activity times are set to accommodate climate, crowd size and the best viewing options for our groups. At times, early morning departure times may help create a better experience. Therefore, late arrivals cannot be accommodated.

Changes to Itineraries.
TourNinjaPhuket reserves the right to make changes to any published itineraries which we deem insignificant and which are due to reasons beyond our control. In such cases, we will arrange for the substitution of comparable services.

While no changes are anticipated, there may be occasions when certain alterations become necessary. These can be due to Thai national celebrations, religious holidays, or unforeseen events including weather, tides, governmental closures, acts of God, or any other reason. TourNinjaPhuket reserves the right to change the itinerary due to such unforeseen circumstances or emergencies. Additionally, historic sites undergo renovations from time to time which can obscure viewing or otherwise change the nature of visiting these sites. No tours will be canceled due to renovations, although TourNinjaPhuket may choose to amend itineraries for such sites. These changes will not be considered a material change and will not be considered cause for cancellation by the guest. 

Exclusions.
Any items and matters not referred to in your itinerary are not included in the tour price. Unless otherwise specified, prices do not include any local taxes or Marine Park or other use-fees, including foreign departure, security, port charges, customs, immigration, agricultural, passenger-facility charges or international transportation tax. Prices do not include tips/gratuities to tour directors, drivers or local guides; passport and visa fees; baggage and personal insurance; any items of a personal nature; taxes or duties; and any beverages or food not specifically listed under “Inclusions” on the product pages of the Website.

Cancellations.
If you wish to cancel a reservation made via the Website, please refer to our standard cancellation policy below. When canceling a booking, you will be notified via email, telephone or by text message of the total refund amount you will receive, if any.

The standard cancellation policy for TourNinjaPhuket is:

1. a 100% refund (minus payment processing fees) for cancellations made at least 48 hours in advance of the start date of the experience.
2. Cancellations made within 48 hours of the start date of the experience will receive no refund.

No refunds are available once a tour or service has commenced, or in respect of any package, accommodation, meals or any other services utilized. Please note that there is no refund issued for bad weather once the tour has started. However, if the weather is so bad that the tour cannot commence then we will work to reschedule the tour for you.

Passports, Visas & Insurance.
When you book international reservations using this Website, you are responsible for ensuring that you meet all foreign entry requirements and that your travel documents, including passports, inoculations, and visas, are in order.

For passport and visa requirements, please consult the relevant embassy or consulate for information. Because requirements may change at any time, be sure to check for up-to-date information before booking and departure. TourNinjaPhuket accepts no liability for travelers who are refused entry onto a flight or into any country because of the traveler’s failure to carry the travel documents required by any airline, authority, or country, including countries the traveler may just be passing through enroute to his or her destination.

As visa and health requirements are subject to change without notice, we recommend that you verify health and visa requirements with the appropriate consulate prior to departure. It is also your responsibility to consult your physician for current recommendations on inoculations before you travel internationally, and to ensure that you meet all health entry requirements and follow all medical guidance related to your trip.

We strongly recommend that you purchase a comprehensive travel insurance policy which includes “cancel for any reason” coverage prior to departure to protect your purchase. Such travel protection should include Trip Cancellation or Interruption, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel Protection Plans included cancel for any reason coverage must be purchased in close conjunction with your travel purchase. If you have questions about your travel protection, call your insurer or insurance agent or broker and please review your travel insurance policy carefully for related terms and conditions.

Travel to certain destinations may involve greater risk than others. TourNinjaPhuket urges passengers to investigate and review travel prohibitions, warnings, announcements and advisories issued by their local government and destination country government prior to booking travel to international destinations. It is your responsibility to be aware of any and all requirements for admittance to a country or province, including COVID-19 requirements.  Should you choose to travel to a country that has been issued a travel warning or advisory, TourNinjaPhuket will not be liable for damages or losses that result from travel to such destinations. 

You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing traveler/s to miss flight(s), and subsequent scheduled travel bookings and tours.  TourNinjaPhuket bears no responsibility for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry. 

Force Majeure.
TourNinjaPhuket assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by TourNinjaPhuket that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if we can recover any monies from our Suppliers, we will refund these to you without any charge by TourNinjaPhuket.

Non-Responsibility.
TourNinjaPhuket, and its employees, agents, shareholders, and representatives use third party Suppliers to arrange tours, transportation, sightseeing, and all other services related to this tour. TourNinjaPhuket is an independent contractor and is not an employee, agent, or representative of any of these Suppliers. TourNinjaPhuket does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, ATV, boat, white water rafts, hotel or restaurants, or any other entity that supplies services related to your tour. All Suppliers are independent contractors and are not agents or employees or representatives of TourNinjaPhuket. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all travelers agree that neither TourNinjaPhuket, nor its employees, agents, or representatives are or may be liable for any loss, injury, or damage to any tour traveler or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of TourNinjaPhuket. TourNinjaPhuket assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any traveler that may result from any act or omission on the part of others; TourNinjaPhuket assumes no responsibility or liability for personal property; and TourNinjaPhuket shall be relieved of any obligations under these terms and conditions in the event of any strike, labor dispute, act of God, or of government, fire, war, whether declared or not, terrorism, insurrection, riot, theft, pilferage, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation. TourNinjaPhuket accepts no responsibility for lost or stolen items. TourNinjaPhuket reserves the right to refuse any traveler or potential traveler at its sole discretion.

Assumption of Risk/Waiver, Hold Harmless and Release of Liability.
As a Traveler you are aware that travel in certain areas on the trip you are undertaking may involve inherent risks, some in remote areas. Inherent risks include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travelers, TourNinjaPhuket and its employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness,; known or unknown medical conditions, physical excursion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.

As a Traveler you understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. In order to partake of the enjoyment and excitement of this trip, you are willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness and death. You the Traveler hereby accept and assume full responsibility for any and all risks and agree to and shall hold harmless and fully release Tour Ninja Phuket Co.Ltd., and its owners, employees, agents, and assigns (collectively TourNinjaPhuket) from any and all claims associated with the trip, including any claims of third party negligence and/or the negligence of TourNinjaPhuket and traveler hereby covenant not to sue TourNinjaPhuket for any such claims or join any lawsuit or action that is suing TourNinjaPhuket. This agreement also binds your heirs, legal representatives and assigns. The terms of this ASSUMPTION OF RISK/WAIVER, HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

Indemnification.
Traveler agrees to and shall indemnify and hold harmless TourNinjaPhuket, Tour Ninja Phuket Co.Ltd., and its owners, employees, agents, and assigns (collectively “TourNinjaPhuket”), from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by TourNinjaPhuket (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) traveler’s breach or violation, or threatened breach or violation, of this Agreement and (ii) any damage caused by traveler while participating in the trip.

Your Behavior.
In the sole discretion of TourNinjaPhuket and our Suppliers, TourNinjaPhuket may require any traveler to leave the tour if it is reasonably believed that the traveler has engaged in, is engaged in, or is threatening to engage in, behavior that may adversely affect the safety, security, comfort, enjoyment, or well-being of other travelers or TourNinjaPhuket representatives and our Suppliers, including, but not limited to, behavior that is disruptive, verbally abusive, physically abusive, obnoxious, harassing, discriminatory, or obscene; or has failed or refused, or is failing or refusing, to follow TourNinjaPhuket rules and procedures. In the event a traveler is removed, such traveler may be left at any city or location without any liability to TourNinjaPhuket or its representatives or Suppliers. TourNinjaPhuket shall not be required to refund any portion of the price paid by any traveler who is removed under the terms of this paragraph, nor shall TourNinjaPhuket be responsible for expenses for lodging, medical care, meals, transportation, or any other expenses incurred by the traveler.

Pre-existing Medical Conditions/Persons with Disabilities.
The nature of many of the destinations of our tours and the mode of transport unfortunately mean that in some cases they may be unsuitable for those who use a wheelchair or have a lack of mobility. Naturally we are also bound by the requirements and stipulations of our tour operators. However, we are always happy to discuss the feasibility of your participation in any of our tours.

It is essential that you advise us before booking if you do have any disability or pre-existing medical condition which may affect your tour, or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in considering the suitability of the arrangements and/or in making the booking. TourNinjaPhuket will communicate requests to Suppliers but cannot be responsible if persons with disabilities cannot be accommodated.

Our Suppliers are, unfortunately, unable to offer additional assistance to travelers with limited mobility and all such assistance will need to be provided by whoever the traveler is traveling with. Travelers with disabilities must notify TourNinjaPhuket at the time of booking of status and of the identity of their non-discounted, paid travel companion who will be responsible for providing all necessary assistance.

Photograph/video Likeness.
Traveler hereby gives consent to TourNinjaPhuket to publish any photographs and/or videos of the trip or Traveler in electronic or printed media without obtaining further consent and without compensation. Each Traveler releases TourNinjaPhuket and its representatives from any liability in connection with any use of such photographs and/or video.

Jurisdiction and Governing Law.
This Website is operated by a Thai entity and this Agreement is governed by the laws of the province of Phuket in the country Thailand. You hereby consent to the exclusive jurisdiction and venue of courts in the province of Phuket, Thailand and stipulate to the fairness and convenience of proceedings in such courts for all disputes arising out of or relating to the use of this Website. You agree that all claims you may have against Tour Ninja Phuket Co., Ltd., arising from or relating to this Website must be heard and resolved in a court of competent subject matter jurisdiction located in the province of Phuket, Thailand. Use of this Website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.

Class Action Waiver/Limitation of Damages & Notice of Claim.
You agree that you will only bring claims against TourNinjaPhuket in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. TourNinjaPhuket shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against TourNinjaPhuket unless you have first provided a typewritten notice of claim to TourNinjaPhuket within 30 days after the trip or cancellation of the tour.

Entire Agreement & Severability.
This agreement, including any other documents, including invoices, we provide you, constitutes the entire agreement and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to TourNinjaPhuket. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
